Terms of service

Site owner: Cocolitos (“Cocolitos”, “we”).
Scope: use of cocolitos.eu and associated shops, and the purchase of products/services offered by Cocolitos.

By accessing or using the Services you agree to these Terms and our Privacy policy. If you do not agree, do not use the Services. This document is interpreted under applicable Spanish/EU consumer, e-commerce and data protection law (LSSI-CE, TRLGDCU/RDL 7/2021, GDPR).

1. Access and account

You confirm you are of legal age in your place of residence or have consent to allow use by minors in your care. If you create an account, you are responsible for keeping credentials confidential and for all activity under your account. Information provided must be accurate, complete and current. We may suspend or close accounts that breach these Terms.

2. Our products

We use reasonable efforts to describe products accurately; colours/appearance may vary due to screens or device settings. We may update descriptions, prices or availability at any time. We reserve the right to limit quantities or discontinue products without prior notice.

3. Orders and formation of the contract

Placing an order constitutes an offer to purchase. The sale is concluded when we confirm acceptance and process payment. We may refuse or cancel orders (e.g., out of stock, obvious pricing errors, suspected fraud). Purchases are subject to our Returns & refunds policy. Unauthorised resale is not permitted.

4. Prices, tax and invoicing

Unless stated otherwise, consumer prices displayed within the EU are final and include applicable VAT. Shipping charges and, where applicable, duties/fees will be shown clearly before order confirmation. We currently do not ship outside the EU; if enabled in future, local taxes/customs will not be included unless expressly stated. You agree to provide valid payment details and authorise the corresponding charges.

5. Payment and security

We accept card payments, Shopify Payments, PayPal, Apple Pay and Google Pay. Coupons or limited-time discounts may be offered and are shown before checkout. We apply technical and organisational measures to protect transactions (e.g., TLS/SSL, anti-fraud systems and access controls). Invoices are issued electronically and sent by email to the address provided at purchase.

6. Purchase process

  1. Add products to the basket and review quantities.
  2. Provide billing details and delivery address.
  3. Select payment method and confirm.
  4. You will receive a confirmation email; the contract is formed when we accept the order and process payment. If you spot an error in your details, email contact@cocolitos.eu promptly so we can correct it.

7. Errors, inaccuracies and data correction

Occasionally there may be typos or inaccuracies (e.g., in descriptions, availability or manifest price mistakes). We reserve the right to correct and to cancel orders with an obvious error before dispatch — we will notify you and refund if already paid. If you notice any incorrect data in your order or communications (confirmation, invoice), write to contact@cocolitos.eu and we will adjust it as soon as possible.

8. Shipping, delivery and transfer of risk

Lead times are indicative and may be affected by carriers or external causes. Risk in the Products passes when you or a third party indicated by you take physical possession. If you choose a carrier not offered by Cocolitos, risk passes when the Product is handed to that carrier. See our Shipping policy for detailed conditions.

9. Performance and unavailability

Unless agreed otherwise, we will perform your order without undue delay and within 30 days from purchase. If we cannot supply the product, we will inform you and you may terminate the contract and receive an immediate refund. If, once terminated, there is an unjustified delay in refunding you, you may claim double the amount due (without prejudice to additional damages).

10. Withdrawal and returns (EU consumers)

EU consumers have 14 calendar days from delivery to withdraw without giving reasons, subject to legal exceptions (e.g., personalised goods, unsealed hygiene items, digital content once started). Procedure, timing and scope of refund are set out in the Returns & refunds policy.

11. Legal guarantee of conformity

New consumer goods are covered by the statutory legal guarantee. In Spain, lack of conformity may appear up to three years from delivery (goods) and two years for digital content/services. For the first two years from delivery of a good, lack of conformity is presumed to have existed at delivery (unless incompatible or proven otherwise). This sits alongside any additional commercial guarantee we may offer.

12. Digital content and services (where applicable)

For downloads or digital services, the rules of EU Directive 2019/770 and its implementation in Spain (RDL 7/2021) apply. In certain cases, starting the download with your express consent waives the withdrawal right for that content.

13. Intellectual property

The design, images, texts, trade marks, graphics and materials in the Services are owned by Cocolitos or third-party licensors. Your licence is personal and non-commercial; you may not copy, modify, distribute, create derivative works or exploit the content without prior written permission. Cocolitos reserves all rights not expressly granted.

14. Third-party tools and links

We may provide access to third-party tools or integrations “as is” and “as available”. We do not guarantee their operation nor accept liability for their use. If you access third-party sites from our Services, you do so at your own risk; review their terms and policies before transacting.

15. Relationship with Shopify

We use Shopify technology to host our shop and provide functionalities. However, the sale is made directly with Cocolitos. Shopify is not a party to the sale between you and Cocolitos and is not responsible for products/services purchased. Any purchase-related question should be addressed to Cocolitos (see contact).

16. User-generated content (UGC)

If you submit reviews, ideas or comments, you grant Cocolitos a non-exclusive, worldwide, royalty-free licence to use them for purposes related to the Services. You agree not to infringe third-party rights nor to post unlawful, defamatory, offensive or malware-containing content. We may moderate or remove content at our discretion.

17. Prohibited uses

You may not use the Services for unlawful purposes, to infringe IP or privacy rights, to distribute spam or malicious code, to impersonate others or to carry out unauthorised scraping. We may suspend or terminate access in case of uses contrary to these Terms or to the law.

18. Disclaimer of warranties (Products and Online Services)

Products. Unless an additional commercial guarantee is expressly stated, Cocolitos Products are provided with the applicable statutory guarantees. This clause does not limit your legal guarantee of conformity or your consumer rights.

Online services. The Site and related digital services (e.g., content display, account features or checkout) are provided “as is” and “as available”. We do not guarantee uninterrupted, secure or error-free access, although we apply reasonable measures to keep services operational and secure.

Legal scope. To the extent permitted by law, we do not assume warranties other than those legally required regarding Products and Online Services. Where consumer law mandates minimum guarantees or rights, those prevail.

19. Limitation of liability

To the extent permitted by applicable law, Cocolitos will not be liable for indirect, special or consequential damages (including loss of profits, revenue, data or use) arising from: (a) access to or use of the Site and other online services, or (b) the purchase, receipt, use or inability to use the Products. Nothing above excludes or limits liabilities that cannot be excluded by law (fraud or gross negligence, personal injury, product liability, mandatory consumer rights). These limitations do not affect your statutory rights.

20. Indemnity

To the extent permitted by law, you agree to hold Cocolitos harmless from third-party claims arising solely from: (a) your unlawful use of the Site or online services; (b) content you provide (reviews, comments, materials) that infringes third-party rights; or (c) your breach of these Terms. This obligation does not extend to normal use of Products nor limit your consumer rights. Cocolitos may assume the defence and settlement of such claims; if so, you will cooperate in good faith.

21. E-commerce compliance and complaints

As an information society service provider, we comply with LSSI-CE (pre-/post-contract information, commercial communications, etc.). For complaints, please contact us via the channels below.

22. Alternative dispute resolution (ADR)

You can refer disputes to accredited ADR entities in Spain (e.g., Consumer Arbitration Boards) or to the European Consumer Centre in Spain for cross-border purchases, without prejudice to your right to bring claims before the competent authorities or courts. Note: the European Commission’s ODR platform was discontinued on 20/07/2025.

23. Changes to the Terms

We may update these Terms by publishing a revised version with an updated date. We will notify material changes where required by law. Continued use of the Services after publication implies acceptance of the changes.

24. Force majeure

We will not be liable for delays or failures due to causes beyond our reasonable control (e.g., natural disasters, strikes, widespread Internet/third-party service outages, armed conflicts or health emergencies). In such cases, obligations are suspended for the duration and we will keep you informed; you may cancel if the situation is unreasonably prolonged.

25. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the courts of Barcelona (Spain) shall have jurisdiction, without prejudice to mandatory consumer rights allowing you to litigate in your domicile.

26. Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign or transfer this agreement as part of a business reorganisation.

27. Severability

If any clause is held invalid or unenforceable, it will be interpreted to reflect the original intent and will not affect the validity of the remainder.

28. Entire agreement and waiver

These Terms and the policies incorporated by reference (e.g., Privacy policy, Returns & refunds policy and Shipping policy) constitute the entire agreement between you and Cocolitos regarding the Services. Failure to enforce a right does not constitute a waiver.
